Re-assessment

A re-assessment is a fresh EHC needs assessment for a child or young person who already has a plan. The parent, the young person, or the school or college can ask for one. The council must then re-assess unless it assessed in the last 6 months or decides a further assessment is not necessary. It must say whether it will re-assess within 15 days of receiving the request. A refusal to re-assess can be appealed to the SEND Tribunal.

After a re-assessment, any amended or replacement plan must be sent within 14 weeks of the council telling the family it will re-assess (or of its own decision to re-assess). The draft has the same 15-day period for comments as a new plan. The plan must then be reviewed within 12 months of that plan being sent. A decision after a re-assessment not to amend or replace the plan can be appealed. For a young person over 18, when deciding whether to re-assess, the council must have regard to whether the education or training outcomes in the plan have been achieved.
