Explain
Amending a plan
The council can change (amend) an EHC plan after a review, or at any other time. It must first send the parent or young person the current plan, a notice of the proposed changes, and the evidence for them. They then have at least 15 days to comment, ask for a particular school or college, and ask for a meeting. The final amended plan, or a decision not to amend, must follow within 8 weeks of the notice.
After a re-assessment, a plan is amended or replaced under different rules, with a 14-week time limit: see "Re-assessment". The amended plan can be appealed to the SEND Tribunal on Sections B, F and I. A decision not to amend after a review or re-assessment can also be appealed.
