What a plan is checked against (27)
The requirements the plan checks look for, each with its source.
- The plan sets out what reg 12(1) lists, each section separately identified: Sections A to I, and Section J where special educational provision is to be secured by a direct payment. The advice is attached as Section K. Law (Act or Regulations)req.plan.sections
- Each section of the plan is separately identified. Law (Act or Regulations)req.plan.separately_identified
- The plan includes each section, separately labelled with its letter. Plenda reads this as including a section where nothing applies, which can say so under its heading. Code of Practice: must (restates the law)req.plan.sections_labelled
- Section A sets out the views, interests and aspirations of the child and their parents, or of the young person. Law (Act or Regulations)req.plan.a_views
- Section B specifies all of the child or young person's identified special educational needs. Law (Act or Regulations)req.plan.b_needs
- Outcomes describe the benefit or difference provision should make for the child or young person, and should be specific, measurable, achievable, realistic and time-bound. Code of Practice: should (follow unless there is a good reason not to)req.plan.e_outcomes
- Special educational provision in Section F is detailed and specific. Code of Practice: must (restates the law)req.plan.f_specific
- Section F provision should normally be quantified: its type, hours and frequency, and the level of expertise. Code of Practice: should (follow unless there is a good reason not to)req.plan.f_quantified
- Section F specifies provision for each need in Section B. Code of Practice: must (restates the law)req.plan.f_each_need
- The council must secure the special educational provision in Section F. Law (Act or Regulations)req.plan.f_secured
- Health or social care provision that educates or trains a child or young person is treated as special educational provision, and is included in Section F. Law (Act or Regulations)req.plan.educates_or_trains
- Speech and language therapy should normally be recorded as special educational provision. Code of Practice: should (follow unless there is a good reason not to)req.plan.slcn_in_f
- Section G sets out the health care provision reasonably required by the learning difficulties and disabilities that result in special educational needs, and it should be detailed and specific. Code of Practice: should (follow unless there is a good reason not to)req.plan.g_provision
- Section H1 sets out the social care provision that must be made under section 2 of the Chronically Sick and Disabled Persons Act 1970, and it should be detailed and specific. Section H2 sets out any other social care provision reasonably required by the learning difficulties or disabilities that result in special educational needs. Code of Practice: should (follow unless there is a good reason not to)req.plan.h_provision
- Section H2 sets out any other social care provision reasonably required by the learning difficulties or disabilities that result in special educational needs (SEND Regulations 2014, reg 12(1)(h)). Separately, as good practice and not a legal requirement: saying what is provided, how often and who provides it makes the provision easier to follow and check. Unlike its rows for Sections F, G and H1, the Code's row for Section H2 does not say how detailed the provision should be (see the table in para 9.69 of the SEND Code of Practice). Good practicereq.plan.h2_provision
- A draft plan must not name a school or other institution, or a type of school or institution. This applies to the draft of a new plan and to a draft issued after a re-assessment. Law (Act or Regulations)req.plan.i_not_in_draft
- A final plan names the school or other institution to be attended and states its type or, where no institution is named, states the type of school or institution, unless the council arranges education otherwise than at a school or college. Law (Act or Regulations)req.plan.i_final
- Where the council arranges special educational provision otherwise than in a school or college (s 61), Section F must still be detailed and specific (Code 9.69). Saying who delivers it and where makes it possible to secure. Code of Practice: must (restates the law)req.plan.eotas
- Where parents arrange suitable education at home, the council does not have to secure the provision in Section F, but the plan is still maintained and reviewed. Law (Act or Regulations)req.plan.ehe
- Where special educational provision is to be secured by a direct payment, Section J sets out the needs and outcomes it is to meet. Law (Act or Regulations)req.plan.j_direct_payment
- Where there is a personal budget, Section J should give detailed information on it, including the arrangements for any direct payments. Code of Practice: should (follow unless there is a good reason not to)req.plan.j_personal_budget
- The plan must include details of the arrangements for any personal budget, including any direct payment. For a direct payment for special educational provision, the Regulations require the plan to set out the special educational needs and outcomes it is to meet. Code of Practice: must (restates the law)req.plan.personal_budget_in_plan
- From Year 9, the plan includes provision to help the young person prepare for adulthood and independent living. Law (Act or Regulations)req.plan.pfa_year9
- Plans should be clear, concise, understandable and accessible, describe positively what the child or young person can do, and be forward looking. Outcomes should be SMART. Plans should have a review date. Reviews should consider whether the plan is still appropriate and whether changes are needed. Code of Practice: should (follow unless there is a good reason not to)req.plan.principles
- The assessment seeks advice from the parent or young person, and educational, medical, psychological and social care advice, plus preparing-for-adulthood advice from Year 9 and any advice the family reasonably asks for. Advice under reg 6(1)(b) to (h) is not sought again if earlier advice exists and the adviser, the council and the parent or young person are all satisfied it is sufficient. Law (Act or Regulations)req.advice.types
- Where the child or young person appears to have a hearing or vision impairment and the person giving the educational advice is not qualified to teach children with that impairment, the educational advice is given after consulting someone who is. Law (Act or Regulations)req.advice.sensory
- When preparing the plan, the council must take into account the evidence received when securing the EHC needs assessment, which includes the advice and information gathered. Law (Act or Regulations)req.advice.taken_into_account
