Explain
Moving to another council area
A child or young person with a plan may move to another council area in England. The old council must then transfer the plan to the new council on the day of the move. If it did not know about the move at least 15 working days before, it must do so within 15 working days of finding out. The new council must then maintain the plan. Within 6 weeks it must tell the parent or young person that the plan has been transferred, whether it will assess, and when it will review the plan.
The new council must review the plan by the later of two dates. One is the end of the 12 months beginning with the day the plan was made or last reviewed. The other is the end of the 3 months beginning with the day of the transfer. The move may mean the child or young person cannot practicably attend the school or college named in the plan. If so, the new council must arrange for them to attend another school or other institution appropriate for them until it is possible to amend the plan. After a move out of England, the English council is no longer responsible and may cease the plan; a decision to cease can be appealed.
